The Site is provided at no charge with the express condition that users agree to be bound by the terms and conditions (“Terms”) set forth herein after the Privacy Policy. These Terms state the rules and agreement that govern your access to and use of the Site, including any content, functionality and services offered on or through the Site, whether as a guest or a registered user.

This Privacy Policy applies only to information that we collect from users of the Site. By using this Site, you consent to the data practices described in this policy. NSC is committed to your privacy and protecting your information. This statement is to explain how the information you share with us is used.

We may revise this Privacy Policy or Terms of Use from time to time. When we do, we will also revise the "last updated" date at the bottom of this document. Users are responsible for regularly reviewing the current policy and terms. Continued use of the Site after we post any revisions constitutes your agreement to any such revisions.

NSC Privacy Policy

What information do we collect from this Site?

We collect certain information automatically each time you visit the Site to customize your experience while visiting the Site, to provide general statistics regarding use of the Site and to evaluate and improve the design and operation of the Site. This may include, without limitation, your IP address, the type of computer you use and the web browser you use.

We do not collect any personally identifiable information unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain products or services available on the Site or for other transactions you initiate on the Site. This information may include your name, your email or street address and phone number. We may collect this information when you register to use this Site, create an account on this Site, subscribe to a newsletter and update and/or modify information that is maintained on the Site.

Use of Cookies

We may also use "cookies" and "web beacons." A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer's hard drive. Among other things, cookies provide a means for websites you visit to keep track of your online patterns and preferences. A cookie will not allow a website to learn any personally identifiable information (such as your real name and address) that you have not otherwise disclosed. Web beacons, also known as clear GIFs or single-pixel GIFs, are small image files that we may place on web pages and within web-based email newsletters that we send. Working in conjunction with cookies, web beacons allow us to accurately count the number of unique users who have visited a specific page and the number of times those pages are displayed. We can also use web beacons to let us know how many people opened a web-based email newsletter.

You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Site.

In addition, the Site uses web analytics services, such as Google Analytics, that use cookies to help analyze how users view the Site. The information generated by the cookie about your use of the Site (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Site, compiling reports on website activity for website operations and providing other services relating to website activity and Internet usage. Google may also transfer this information to third parties where required to do so by law or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google. By using this Site, you consent to the processing of data about your use of the Site by Google in the manner and for the purposes set out above.

How do we use the information we collect?

We use personally identifiable information for the purpose for which it was provided to us. For example, we may use personally identifiable information that you submit when registering for the Site to establish your online account, to send you newsletters, information and reports that you may be interested in, and/or to contact you directly about products or services that you may have purchased or be interested in. We may use personally identifiable information that you submit to apply for a job for purposes of evaluating your candidacy for any applicable jobs. We may also use personally identifiable information to send you emails about the Site, respond to emails, provide customer support, promotional offers, alerts and other similar matters or general communications.

We may use non-personally identifiable aggregate information to help us run and maintain the Site, study traffic patterns and generally learn about the usage of the Site. We may also use such information for purposes of system administration, to improve the design and content of the Site, and/or to enable us to personalize your Internet experience.

We may use certain tools or services to keep track of the websites and pages our users visit within the Site, to determine what services our users prefer. This data is used to deliver customized content and advertising within the Site to users whose behavior indicates that they are interested in a particular subject area.

How is the information that is collected disclosed?

We may share information obtained from the Site with our Chapters, partners and/or other similar organizations. Except as provided in this Privacy Policy, (a) we do not sell, rent or trade with unaffiliated third parties any personally identifiable information that you provide to us through the Site.

We may disclose personally identifiable information about you to third parties who provide services to us and who agree to maintain such information in accordance with this Privacy Policy. These third parties may provide a variety of services to us including, without limitation, hosting this Site, processing and storing user information, updating your customer information records in our database (including address verification), and sending or coordinating the sending of marketing communications on our behalf.

We may disclose personally identifiable information in special cases with or without notice to you when we have reason to believe that disclosing such information is necessary to identify, contact or bring legal action against someone who may have breached our Terms of Use or who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other users of the Site or anyone else who could be harmed by such activities. We may also disclose personally identifiable information when we reasonably believe that the law requires it.

We may acquire, sell or change our affiliation with independent Chapters or other organizations or engage in other business purchases, sales or affiliations. In such transactions, personally identifiable information is sometimes one of the transferred business assets, but remains subject to any pre-existing Privacy Policy. If part of our organization were to be sold or merged with another organization, or if NSC declares bankruptcy, some or all of the information collected from you may be transferred to a third part as a result of the transfer of assets.

We may disclose non-personally identifiable information in aggregate form to third parties including, without limitation, advertisers and business partners.

Do users have a choice as to whether to provide information to us?

You can choose not to provide personally identifiable information to us. However, if you do not provide such information, you may not be able to access or use certain portions of the Site. If you receive addition emails from the Council, you can always opt out by unsubscribing, as indicated at the bottom of the email.

Can users access their information?

If you are a registered NSC member or have created a login account, you can access, change, correct and update the personally identifiable information that you provide through your account on this Site.

How do we protect the security of users' information?

We maintain physical, electronic and procedural safeguards to reduce the risk of unauthorized access to personal information. We use Secure Sockets Layer (SSL) Protocol when we transmit personal information (such as credit card numbers`) to another website. However, although we employ such safeguards, information transmitted on the Internet and/or stored on systems connected to the Internet is not 100% secure and there are security and privacy limitations inherent to the Internet that are beyond our control. As a result, we cannot ensure, warrant or guarantee the security or integrity of such information.

Reasonable access to your personal data will be provided at no cost upon request made to NSC at [email protected]. If access cannot be provided within a reasonable time frame, NSC will provide you with a date when the information will be provided. If for some reason access is denied, we will provide an explanation as to why access has been denied.

How do we protect a child's privacy?

The Site is a general audience website. We do not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this Site.

If you enter information or otherwise use the Site on behalf of another person or entity, you consent both on your own behalf and on behalf of that other person or entity to NSC collection, use and disclosure of such information whether it is information of yours or such other person or entity, in accordance with this Privacy Policy. You also represent and warrant that you have the authority to consent on behalf of such other person or entity.

Does the Site contain links to other websites?

While you are using the Site, you may be linked or directed to other third party sites outside of the Site that are beyond our control. Each of these third parties may have a privacy policy different from ours. Please review the privacy policies of these sites. We are not responsible for any actions or privacy policies of such third parties. The Council includes links to other sites that may be helpful to you; however, links from the Site to another website shall not represent an endorsement by NSC, its members, board of directors, committees, Divisions or staff.

The Site uses interfaces with social media sites such as Facebook, LinkedIn, Twitter and others. If you choose to "like" or share information from the NSC website through these services, you should review the privacy policy of that service. If you are a member of a social media site, the interfaces may allow the social media site to connect your site visit to your personal data.

Acceptance of Terms of Use

Please read the Terms of Use (Terms) carefully before you start to use the Site. By using the Site you acknowledge that you have read and agree to fulfill the obligations set for in these Terms, which forms a binding contract between you and the National Safety Council. If you do not agree with these Terms, please do not access or use the Site.

We reserve the right to modify these Terms from time to time by updating this page. Changes, revisions or updates are effective immediately upon posting. Your continued use of this Site after we post any revised Terms means that you accept our revised policy.

We reserve the right to withdraw or amend this Site, and any material or service we provide on the Site, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Site is unavailable at any time or for any period.

Terms of Use

The Site is made available to persons 18 years of age or older as a user of the Site for any and all purposes.

NSC owns and maintains the Site for educational and informational purposes only, and it is solely for personal, non-commercial use, except where training and other products or services are available for sale. Additionally, the Site provides NSC members with benefits exclusive to them. All materials on the Site, including but not limited to all information, images, text, video and audio, displays, data, trademarks, service marks and logos (including the design, selection and arrangement thereof) are, unless otherwise noted, the exclusive property of NSC and are protected by United States copyright, trademarks and other applicable laws.

You must not copy, download, reproduce, republish, reuse, distribute, transmit, store, create derivative works of, publicly display, or modify any of the material on the Site for any purpose without the express written permission of NSC, except that you may make such temporary copies in a single computer’s RAM and hard drive cache as are necessary to browse the Site. You may also make a single copy of the content displayed on any page of the Site to be used for your personal or educational and non-commercial use which does not harm the reputation of NSC, provided that you do not remove any trademarks, copyrights and any other notice contained in such content.

If you use the Site in breach of these Terms, your right to use the Site will cease immediately and you must, at our option, return or destroy any copies of any materials you have created. No right, title or interest in or to the Site or any content thereof is transferred to you, and all rights not expressly granted are reserved by NSC. Any use of the Site not expressly permitted by these Terms is a breach of the Terms and may violate copyright, trademark and other applicable laws.

Content Usage

Unless otherwise indicated, all information and material contained on this Site, such as text, graphics, logos and images, are protected by U.S. copyright laws and proprietary to the National Safety Council. NSC Site content may not be reproduced in whole or in part by persons or organizations other than NSC, its affiliates and members, Divisions and units without prior written copyright permission.

NSC authorizes permission to reprint specific articles, infographics and other educational information on a case-by-case basis. If your request is granted, you agree to the following:

  • You will not alter, delete, add or otherwise change the content except as approved in writing by NSC or as necessary to format the content for your lawful purpose consistent with the information you provide to us in the permission request.

International Users

The National Safety Council makes no representation that content, materials or products available on or through the Site are appropriate or available for use outside of the United States. Statistics, facts and best practices are based on U.S. data, regulations and practices. If you access or use the Site from a location outside the United States, you are responsible for compliance with applicable laws, including local laws regarding online conduct and content and use, local society rules and policies and U.S. export laws and regulations.

Security

You may be given the opportunity to access the Site as a registered user that will allow you to receive information from NSC and/or to participate in certain features on the Site. You may be asked to provide certain registration details or other information. You represent and warrant that all information you provide to use and register with this Site is governed by our Privacy Policy, also located herein. During the registration process you may be required to choose a password. You acknowledge and agree that NSC may rely on this password to identify you. You are responsible for all use of your Account, regardless of whether you authorized such access or use, and for ensuring that all use of your Account complies fully with the provisions of these Terms.

Users are prohibited from violating or attempting to violate the security of the Site.

The NSC blog, Safety First, and other interactive media sponsored by NSC, including Facebook, LinkedIn or Twitter, may enable users to post, submit, publish, display or transmit to other users (hereinafter “post”) content (collectively “User Contributions”) as comments or other posts. In addition, users may be permitted to link to the Site in accordance with the NSC Linking Policy.

All User Contributions, and any website on which a link to the Site appears (“Linked Site”), must comply with the following Content Standards:

User Contributions and Linked Sites must in their entirety comply with all applicable federal, state, local and international laws and regulations. Without limiting the foregoing, User Contributions and Linked Sites must not:

  • Give the impression that they emanate from or are endorsed by us or any other person or entity, if this is not the case.

In addition, User Contributions must not involve commercial activities or sales, such as contests, sweepstakes and other sales promotions, barter or advertising.

You hereby agree and acknowledge that you are responsible for the content of any User Contribution you submit and/or of your Linked Site, and you have full responsibility for such content, including its legality, reliability, accuracy and appropriateness.  We are not responsible, or liable to any third party, for the content, accuracy, completeness, or usefulness of any User Contribution or of any Linked Site. Any User Contribution posted to the Site will be considered non-confidential and non-proprietary.

By providing any User Contribution on the Site you:

Monitoring and Enforcement; Termination

We have the right, but not the obligation, to monitor the content posted on the NSC Blog. We may, in our sole discretion:

  • Remove or refuse to post any User Contributions for any reason;
  • Take any action with respect to any User Contribution that we deem necessary or appropriate, including if we believe that such User Contribution violates the Terms of Use;
  • Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy;
  • Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Site; or
  • Terminate or suspend your access to all or part of the Site for any or no reason, including without limitation, any violation of these Terms of Use.

In addition, we have the right to fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through the Site. You waive and hold harmless NSC from any claims resulting from any action taken by NSC during or as a result of its investigations and from any actions taken as a consequence of investigations by either NSC or law enforcement authorities.
